Procedure for obtaining service on In-State Process
The service fee for In-State Process is $30 per person
Requirements for Wake County Sheriff's Office of Civil Process:
• A Summons I Notice / Order/ Subpoena/ Etc. with complete service address
(to be returned to Clerk of Court)
• A Summons I Notice I Order I Subpoena/ Etc. (to be served to defendant/s -
with complaint or attachments)
• Magistrate Summary Ejectments Only: In addition to having the above,
include a stamped envelope addressed to the defendant along with an
additional summons and complaint inside (not sealed).
• An Affidavit of Service (if a Return of Service is not provided with the original
service document).
• (Optional) Return of Service mailed to Plaintiff, enclose a self-addressed
stamped envelope. Otherwise, it will be filed at the originating county's Clerk
of Court.
• Payment: Cash, check (no starter checks), or money order if paying in office
(no credit or debit cards accepted). Payable to the Wake County Sheriffs
Office.
Procedure for obtaining service on Out-of-State Process
As of July 1, 2025, the service fee for Out-of-State Process is $100 per person.
Out of State service only involves processes outside of North Carolina Courts to be served upon a Wake County resident.

- Physical address required; we are unable to serve to a post office box.
