Wake County Sheriff's Office Victim Services

The Victim Services and Domestic Violence Unit is responsible for processing and serving domestic violence protective orders and restraining orders. Victim Services works with the victims of domestic violence to ensure that we have all the available information needed so the deputies of the Domestic Violence Unit can serve the orders in a timely manner. Deputies within the Domestic Violence Unit also assist and respond to domestic violence calls throughout Wake County.

What is Domestic Violence?

Domestic violence (also referred to as intimate partner violence (IPV), dating abuse, or relationship abuse) is a pattern of behaviors used by one partner to maintain power and control over another partner in an intimate relationship.

Anyone can be a victim — or perpetrator — of domestic violence. That includes behaviors that physically harm, intimidate, manipulate, or control a partner or otherwise force them to behave in ways they don’t want to. This can happen through physical violence, threats, emotional abuse, or financial control.

Warning Signs

Common signs of abusive behavior in a partner might include:

  • Telling you that you never do anything right.
  • Showing extreme jealousy of time spent with friends away from them.
  • Preventing you or keeping you from spending time with friends and family.
  • Insulting, demeaning, or shaming you in, especially in front of other people.
  • Preventing you from working or attending school.
  • Controlling household finances without discussion, including taking your money or refusing to provide money for necessary expenses.
  • Pressuring you to have sex or perform sexual acts that you are not comfortable with.
  • Pressuring you to use drugs or alcohol.
  • Intimidating you through threatening looks or gestures.
  • Insulting your parenting or making threats to harm or take away your children or pets.
  • Threatening you with weapons like guns, knives, or bats.
  • Destroying your belongings in your home.

Domestic Violence Statistics

  1. An average of 24 people per minute are victims of rape, physical violence or stalking by an intimate partner in the United States — more than 12 million women and men over the course of a single year.
  2. Nearly 3 in 10 women (29%) and 1 in 10 men (10%) in the US have experienced rape, physical violence, and/or stalking by a partner and reported it having a related impact on their functioning.
  3. Just under 15% of women (14.8%) and 4% of men in the US have been injured as a result of intimate partner violence that included rape, physical violence, and/or stalking by an intimate partner.
  4. 1 in 4 women (24.3%) and 1 in 7 men (13.8%) aged 18 and older in the US have been the victim of severe physical violence by an intimate partner in their lifetime.
  5. Intimate partner violence alone affects more than 12 million people every year.
  6. Over 1 in 3 women (35.6%) and 1 in 4 men (28.5%) in the US have experienced rape, physical violence, and/or stalking by an intimate partner in their lifetime.
  7. Almost half of all women and men in the US have experienced psychological aggression by an intimate partner in their lifetime (48.4% and 48.8%, respectively).
  8. Women ages 18 to 24 and 25 to 34 generally experience the highest rates of intimate partner violence.
  9. From 1994 to 2010, approximately 4 in 5 victims of intimate partner violence were female.
  10. Most female victims of intimate partner violence were previously victimized by the same offender at rates of 77% for women ages 18 to 24, 76% for ages 25 to 34, and 81% for ages 35 to 49.

Steps to Obtain a Domestic Violence Protection Order (50B Order) or a Civil No-Contact Order (50C Order)

  1. Go to the Wake County Courthouse located at 316 Fayetteville St., Room 527, 5th Floor Civil Clerk of Court and Domestic Violence Unit to obtain the paperwork and complete it.
  2. Complete the paperwork with detailed information including dates.
  3. For 50B filings, effective February 2023, Efiling Options in Wake County are available, eCourts Guide & File – Domestic Violence. File electronically at https://northcarolina.tylertech.cloud/SRL/ . You will still need to appear in person to request an order. 
  4. New filings are accepted between 8:30am and 3:30pm, weekdays except state holidays.
  5. The Order will be heard in Courtroom 5A/5B. When the Judge calls your name, you will be sworn in to testify about the complaint you have filed.
  6. Once the Judge signs the paperwork, go back to Room 527. The Clerk will make you copies of the Order.

 

Once the Order is filed it will be sent to the Wake County Sheriff's Office and sent out into the field for service on the Defendant. The Sheriff’s Office cannot provide a specific time for any service.

PASOS PARA OBTENER UNA ORDEN DE PROTECCIÓN POR VIOLENCIA DOMÉSTICA (50B) O UNA ORDEN DE NO CONTACTO POR ACOSO (50C)

  1. Vaya a la Corte de Justicia del Condado de Wake ubicado en la 316 Fayetteville St., Sala 527, quinto piso, Oficina del Secretario Civil y Unidad de Violencia Doméstica para obtener las formas y completarlos.
  2. Complete las formas con información detallada, incluyendo fechas.
  3. Para las solicitudes 50B, a partir de febrero de 2023, están disponibles las opciones de presentación electrónica (Efiling) en el Condado de Wake, eCourts  Guide & File – Violencia Doméstica. Puede presentar electrónicamente en https://northcarolina.tylertech.cloud/SRL/. Aun así, todavia deberá presentarse en persona para solicitar la orden.
  4. Se aceptan nuevas solicitudes entre las 8:30 a.m. y las 3:30 p.m., de lunes a viernes, excepto días festivos estatales.
  5. La orden será escuchada en la Sala 5A/5B. Cuando el juez llame su nombre, prestará juramento para testificar sobre la denuncia que ha presentado.
